For the consideration set forth above, Model agrees as follows:
Photographer has permission to photograph Model. All photographs (“Photographs”) taken by Photographer will be the sole and perpetual property of the Kansas Department of Wildlife, Parks and Tourism (“Department”), and Department’s heirs, successors, assigns, and licensees.
All Photographs may be used by Department for any purpose or cause, including editorial, trade, product, advertising, promotion, endorsements, display, artistic, and commercial purposes in any manner or medium. Model waives any right to inspect or approve the Photographs and any works created therefrom (“Works”), including prints, digital images, composites, alterations, derivative works, and products (whether for commercial, artistic, editorial, advertising, or any other purpose).
Department has the unrestricted right to retouch, composite, edit, alter, and create derivative works from the Photographs and the likeness of Model, without restriction. Model agrees Model will hold no rights or license to the Photographs and any Works created from the Photographs. Model relinquishes any and all rights in the likeness of the Model in the Photographs and Works. Model waives any right to inspect or approve any written copy or other information published in connection any Works, or the use to which any Works may be applied.
Department may use the photographs or any reproductions of them for any advertising purposes or to illustrate any wording. Model agrees no such wording shall be considered to be attributed to Model personally, unless Model’s name is used. Provided Model’s name is not used in connection with any statement or wording attributed to Model’s likeness, Model will not prosecute or institute any actions, proceedings, claims or demands against Department or Photographer regarding any usage of the Photographs. Model releases, discharges, and agrees to save harmless and defend Department, its agents, employees, heirs, successors, legal representatives, assigns, and licensees, including without limitation Photographer, as well as all persons acting under them or with their permission or authority from any liability for any blurring, distortion, alteration, optical illusion, or use of the Photographs in any Works, whether intentional or otherwise, as well as any publication thereof; even though it may subject Model, his/her/its heirs, representatives, successors, and assigns, to ridicule, scandal, reproach, scorn, or indignity. Model releases and agree to save harmless Department or Photographer from any and all claims arising out of the use of Model’s likeness and any Work created from Model’s likeness, including such claims as libel, slander, violation of privacy, or appropriation of Model’s likeness.
The undersigned warrants he/she is a legally competent adult and is authorized to sign; or if Model is a minor, the undersigned who is executing this agreement as Model’s parent or guardian warrants he/she has authority to sign this agreement on Model’s behalf and bind Model.
The undersigned state(s) he/she/they have (has) read the above authorization, release, and agreement, prior to its execution, and that he/she/they are fully familiar with the contents hereof. This agreement shall be binding upon Model and his/her heirs, legal representatives, successors, and assigns.
